Terms of Service
These Terms govern your use of the Upholm online store and any purchase you make through it. Please read them before ordering. By placing an order you accept these Terms.

References to "we", "us" and "our" mean the above trader. References to "you" mean the customer.
2. Who may buy
You must be at least 18 years old, or the age of majority in your country of residence, and legally capable of entering into a binding contract.
3. Products and descriptions
We take care to describe our products accurately, including their materials, dimensions and intended use. Product photographs are illustrative; minor variation in colour may occur between screens and the physical product.
Upholm products are ergonomic desk accessories intended for general comfort and posture support. They are not medical devices, and nothing on this store is medical advice. If you have a diagnosed condition affecting your back, neck or wrists, consult a qualified healthcare professional before use.
4. Prices
All prices are shown in euro (EUR) and include applicable VAT unless stated otherwise at checkout. Delivery costs are shown separately at checkout before payment.
We may change prices at any time, but changes do not affect orders we have already accepted. If a product is listed at a manifestly incorrect price due to an obvious error, we may cancel the order and refund you in full; we will contact you before doing so.
5. How a contract is formed
Your order is an offer to buy. We accept it when we send you a dispatch confirmation email — at that point a contract exists between us. An order confirmation email acknowledges receipt of your order but does not by itself constitute acceptance.
We may decline an order if the item is unavailable, if we cannot obtain payment authorisation, if we cannot deliver to your address, or if we suspect fraudulent use.
6. Payment
Payment is taken at checkout through our payment providers. We do not store your full card details. You confirm that you are authorised to use the payment method you provide.
7. Delivery
Delivery terms, costs and timescales are set out in our Shipping policy, which forms part of these Terms. Risk in the goods passes to you on delivery.
8. Right of withdrawal and returns
If you are an EU consumer you have a statutory right to withdraw within 14 days, and we additionally offer a voluntary 30-day money-back guarantee. Both are set out in full in our Returns & Refunds policy, which forms part of these Terms.
9. Legal guarantee of conformity
Goods must be as described, fit for purpose and of satisfactory quality. As an EU consumer you benefit from a legal guarantee of conformity of at least two years from delivery under Directive (EU) 2019/771, free of charge. These Terms do not affect that right.
10. Acceptable use
You agree not to use this store unlawfully, not to attempt to gain unauthorised access to it, not to interfere with its operation, and not to extract its content by automated means for commercial purposes.
11. Intellectual property
The Upholm name, logo, product photography, text and page design are owned by us or licensed to us and are protected by intellectual property law. You may not reproduce them commercially without our written permission.
12. Reviews and submitted content
If you submit a review or other content, you confirm it is your own honest opinion and does not infringe anyone's rights. You grant us a non-exclusive, royalty-free licence to display it in connection with the store. We may remove content that is unlawful, misleading or abusive.
13. Liability
We are liable for foreseeable loss caused by our breach of these Terms. We do not exclude or limit liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or under product liability law.
We are not liable for loss arising from your failure to follow product instructions, or from use of a product for a purpose it was not designed for.
Nothing in these Terms affects your mandatory rights as a consumer.
14. Privacy
Our handling of personal data is described in our Privacy Policy.
15. Complaints
If something has gone wrong, email us first — most issues are resolved quickly and directly. We aim to respond to written complaints within 15 days.
16. Governing law
These Terms are governed by Croatian law. If you are a consumer resident in another EU member state, you keep the protection of the mandatory consumer-law provisions of your country of residence, and you may bring proceedings in the courts of that country.
17. Changes to these Terms
We may update these Terms from time to time. The version published on this site when you place your order is the version that applies to that order.
